Copyright & DMCA Policy
Last updated
Tokomi respects the intellectual property rights of others and expects our users to do the same. This Policy describes how copyright owners can notify us of alleged infringement on the Service, how users can respond, and how we handle repeat infringers. It is our policy to respond to notices that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512, the “DMCA”) and other applicable law, and to terminate the accounts of repeat infringers in appropriate circumstances.
1. Reporting copyright infringement
If you believe that content on Tokomi infringes a copyright you own or control, send a written notice to our designated copyright agent that includes all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by one notice, a representative list of those works.
- Identification of the material you claim is infringing, with enough information for us to locate it — for example the URL of the character, image, comment or profile.
- Your name, mailing address, telephone number and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Please consider whether the use might be fair use or otherwise authorized before sending a notice. Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.
2. Designated copyright agent
Starloom Interactive Pte. Ltd., Attn: Copyright Agent, 25 Seah Street, #02-01, Singapore 188381. Email: [email protected] (subject line “DMCA Notice”). Email is the fastest way to reach us. Notices that do not relate to copyright infringement will not receive a response through this channel; see Section 6.
3. What happens next
When we receive a complete and valid notice we will remove or disable access to the identified material, notify the user who posted it and provide them with a copy of the notice (which may include your contact information), and record the notice against that user’s account. We may also share the notice with the user for the purpose of responding to it. Incomplete notices may be rejected or may delay our response.
4. Counter-notice
If you believe your content was removed by mistake or misidentification, you may send a counter-notice to our copyright agent that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which Tokomi may be found), and that you will accept service of process from the person who provided the original notice or their agent.
Upon receipt of a valid counter-notice we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material in 10 to 14 business days at our discretion.
5. Repeat infringers
We keep records of infringement notices. Accounts that receive multiple valid notices, or that we determine are repeatedly infringing, will be terminated. We may also terminate an account after a single notice in appropriate circumstances, such as clear commercial-scale infringement. We may decline to restore content or reinstate accounts that have been the subject of repeated notices, even if a counter-notice is submitted.
6. Trademark and other complaints
For complaints that a character, profile or other content infringes a trademark, violates a right of publicity, or is otherwise unlawful but not a copyright matter, email [email protected] with the subject line “IP Complaint” and include a description of the right you hold, evidence of that right, the location of the content, and your contact information. We review such complaints under our Community Guidelines and applicable law.
7. Changes
We may revise this Policy from time to time. The “Last updated” date shows the current version.
