User upload terms (v1)

§1 Definitions

1.1 “Platform” — Tokomi, the operator, affiliates, and vendors who run the product.

1.2 “You” — anyone who signs in or otherwise uses Tokomi and uploads.

1.3 “Upload” — anything you put in a shop, mall, or other surface: images, copy, titles, tags, audio, video, and the rest.

1.4 “Virtual setting” — shops, goods, ranks, “wallets,” and “prices” inside Tokomi are roleplay furniture. They are not real-world goods or money.

§2 You warrant the rights

2.1 You made it, or you have a clean, complete license to upload and show it and to grant what these terms need.

2.2 It does not infringe copyright, trademark, patent, publicity, name, reputation, privacy, trade secret, or any other right, and it does not break the law.

2.3 If it shows a real person's face, voice, name, or other personal data, you have their written (including electronic) consent covering this use.

2.4 Do not upload, among other things:

• Pictures or copy lifted from marketplaces, brand sites, or someone else's shop
• Someone else's art, photos, or writing
• Anime, game, or film characters and fan art of them
• Celebrities, influencers, or any real person's likeness
• Someone else's trademark, logo, or trade dress

2.5 Uploads must be truthful. No impersonation, no fraud.

§3 License to Tokomi

3.1 So we can show the shop, search, rank, cache, and similar, you grant Tokomi a free, non-exclusive, irrevocable (while the upload stays up), worldwide license we may sublicense only to affiliates and vendors who need it to run the product — to store, use, copy, display, resize, convert, make thumbnails, and transmit to users.

3.2 Adaptations are only to fit the product. We do not rewrite your work or sell it as ours.

3.3 The license does not move copyright.

3.4 It lasts while the upload is on Tokomi. After you delete it or close the account we stop using it for the product, except caches, backups, and copies we must keep for law, disputes, or regulators, and only as long as needed.

§4 Virtual only

4.1 Shops, goods, ranks, and wallets are fiction. The “money” has no real value, cannot be cashed out, and is not a real offer to sell.

4.2 Uploads are for in-world play. Not for real commerce, ads, traffic funnels, or laundering.

4.3 Don't use the fiction to break the law. That's on you.

§5 If someone is harmed

5.1 Infringement, illegality, or ownership fights from your upload are yours, not Tokomi's.

5.2 If we are complained about, sued, fined, or otherwise hit because of your upload, you cover the loss — settlements, fines, legal fees, and reasonable enforcement costs.

5.3 We may handle the complaint first and recover from you. That does not limit deletion, limits, or bans.

§6 Notice and counter-notice

6.1 Rights holders can send a notice through the report path: identity and contact, proof of rights, where the upload is, a first showing of infringement, and a statement that the notice is true.

6.2 After a complete notice we may take the content down, hide it, or drop the link, and we pass the notice to you. In a clear emergency we may act first.

6.3 If you think it is not infringement, send a counter-notice with who you are, a first showing it is not, and a truth statement. We forward it and tell the complainant they can go to a court or regulator.

6.4 If the complainant does not show, within a reasonable time (15 days from the counter-notice unless the law says otherwise), that they filed a complaint or a case, we may put the upload back.

6.5 A false notice or counter-notice is the sender's problem. We may limit accounts that file in bad faith.

6.6 Repeat uploaders can be warned, limited, un-shopped, or banned. Virtual balances already spent are not refunded.

§7 What Tokomi is (and isn't)

7.1 We host and show. We do not pre-review every upload. Showing it is not an endorsement.

7.2 If we act promptly on a complete notice, we are not on the hook for that item beyond what the law requires. We can still recover from you.

§8 Minors

8.1 A minor who uploads does it with a parent or guardian, who is responsible.

8.2 No uploads that harm minors or misuse a minor's image. See コミュニティガイドライン.

§9 Personal data

9.1 If an upload has someone else's personal data, you must have a lawful basis to give it to us.

9.2 We handle that data under the プライバシーポリシー.

§10 Changes, law, disputes

10.1 We may revise these terms and say so in-product. Keep using or keep uploading after that, and you accept the new text.

10.2 If one clause fails, the rest stay.

10.3 These terms follow the same governing law and venue as the 利用規約.
